“New York City Sues Manufacturer of OxyContin”
The city of New York has sued Purdue Pharma, manufacturer of OxyContin, claiming the company blocked a generic version of the painkiller, costing the city millions of dollars in payments.
The lawsuit was filed last Friday in federal court. It contends that the city would have saved money on a less expensive, generic alternative. New York pays 25% of the elderly and poor's costs for Medicaid.
Damages sought in the lawsuit total three times the amount the city lost by not being able to use a generic brand. According to city officials, it cost $5.5 million to provide OxyContin in 2002. The losses from not being able to use a generic are still being calculated.
A federal court ruled in January that Purdue Pharma deliberately misled the U.S. Patent Office when the company tried to protect its patents for the popular painkiller. The court's ruling would help clear the way for the manufacture of generics, but Purdue Pharma has appealed.
OxyContin generates an enormous amount of profit for Purdue Pharma, and is both a wildly popular painkiller and a cause for concern in a growing number of communities where the highly addictive drug is abused.
